Malakanyang sa US ban sa PH official na nagpakulong kay de Lima: ‘We are not bothered by it’

Manila, Philippines – Kumbinsido ang Malakanyang na hindi maipatutupad sa mga opisyal ng Pilipinas na may kinalaman sa pagpapakulong kay Senador Leila de Lima ang pinirmahang 2020 State of Foreign Operations Appropriations Bill ni US President Donald Trump.

May probisyon kasi na bahagi ng nasabing bill ang pagba-ban sa mga opisyal ng gobyerno na may kinalaman sa pagpapakulong sa senadora na makapasok ng Estados Unidos.

“ It cannot just be imposed, because there is a colatilla there, there must be a credible information; if the information is not credible, then the US Secretary of State will not impose such sanction,” ani Presidential spokesperson Salvador Panelo.

Iyon nga lamang, hindi maaaring makialam ang gobyerno ng Pilipinas sa proseso ng US legislature.

Ang napansin lamang ani Sec. Panelo sa probisyon na kasama sa inaprubahan ni US President Donald Trump  na may kinalaman sa pagpapatupad ng ban sa mga nasa likod ng pagkakabilanggo ni Senator Leila de Lima at bahagi ng 2020 State of Foreign Operations Appropriations Bill ay mayroong colatilla na, ‘if’ the… – what does it say here? – When the US Secretary of State receives ‘credible information’ in the so-called wrongful imprisonment. In the first place, it’s not a wrongful imprisonment, as we have repeatedly explained that.

So, I suppose the Secretary of State, unlike the two senators who introduced that amendment, is better informed and educated on the internal judicial process of this country and would necessarily follow his informed judgment.”

Base sa naturang probisyon, nakasaad na dapat magpatupad ng ban at hindi payagang makapasok ng US ang mga nasa likod ng “hindi tamang” pagkakabilanggo nina Mustafa Kassem – isang American citizen at pinakulong ng gobyerno ng Egypt, at Senator Leila de Lima na inaresto sa Pilipinas noong 2017.

Ang bahaging ito ay nasa amendment portion ng batas na isinulong nina US Senators Richard Durbin at Patrick Leahy.

Ayon kay  Sec. Panelo, makailang ulit na aniyang ipinaliwanag ng Malakanyang na malabong maging “wrongful detention” ang nangyari kay de Lima dahil dumaan aniya sa dalawang proseso ang senadora.

“One, administrative when the investigating prosecutor conducted a proceeding to determine whether there exists a probable cause for the filing of an information and prosecutor found the existence of one. And then the another process is judicial – the Constitution requires the judge before issuing a warrant for the arrest of an accused to determine, personally examine the evidence before him and if he finds probable cause then he issues a warrant of arrest. So, how can that be a wrongful detention?,” balik tanong ni Sec. Panelo.

At kung sinasabi aniya na ang nangyari kay de Lima ay “trumped up charge” ay dapat lamang na nakita ito ng mga taga-usig ng pamahalaan at maging ng judicial officer na nagpalabas ng warrant.

Sa kabilang dako, bahala na aniya si Foreign Affairs Sec. Teddy Boy Locsin na  gumawa ng pakikipag-usap sa kinatawan ng US hinggil sa naging pag-aresto at pagpapakulong kay de Lima upang maitama ang baluktot na paniniwala ng ilang senador sa Estados Unidos.

Depende naman aniya sa US Secretary of State kung mananatiling maaapektuhan ang mga opisyal ng pamahalaan na kaisa sa pagpapakulong kay de Lima.

“It’s their call. But we are not bothered by it, if that is what you want me to say,” ayon pa rin kay Sec. Panelo.

Samantala, hindi naman nababahala ang Malakanyang sa pinirmahang batas na ito ni Pres. Trump.

“First, it’s their process; we cannot intrude, in the same way that we react when they intrude into our processes. Number two, the very provision says there must be credible information before they ban any official in the Philippines,” lahad ni Sec. Panelo.

DEDMA lang si Sec. Panelo sa pagba-ban sa mga opisyal ng gobyerno na may kinalaman sa pagpapakulong kay de Lima.

Ikinanta kasi ng senadora na kabilang sina Sec. Panelo at Pangulong Rodrigo Roa Duterte sa mga nasa likod ng kanyang political prosecution.

“In the first I have no plans in going there. Number two, you know the statements of De Lima has been completely repudiated by surveys after surveys conducted by credible organizations. The trust rating of the President has surged as well as the approval rating of the President. The 5% disapproval rating is constituted by these people – the opposition, the detractors, the haters, the critics. So, they are not credible in other words,”  ayon pa kay Sec. Panelo.

Bukod dito, wala rin aniya siyang balak na linisin ang kanyang plano sa mga US authorities dahil malinis ang kanyang konsensiya sa usaping ito. Kris Jose
